This Thursday, August 17, the Official Gazette published Law No. 21,595, which “systematizes Economic Crimes and Offenses against the Environment,” amending the Criminal Code and other legal bodies regarding economic crimes, criminal liability of legal entities, and environmental offenses, along with the establishment of a new system for determining sanctions.
Accordingly, the Director of CCL’s Corporate Tax Area, Carlos Tapia, and the Director of CCL’s Consulting Area, Maritza Marchant, shared their opinions regarding the new regulation, which will generally enter into force on the date of its publication: August 17, 2023. However, the provisions that amend Law No. 20,393, which establishes the criminal liability of related legal entities, will come into force 13 months after the publication of the Law.
