On Monday, January 20, Carlos Tapia, Director of the Corporate Tax Area at CCL Auditores Consultores, delivered a presentation on “Impacts of the New Economic Crimes Law on the Mining Industry” at SONAMI’s offices.

At the event, CCL was also represented by Tax Partner Rodrigo Ziade and Audit Partner Carlos Barahona. Representing the National Prosecutor’s Office was Mauricio Fernández, Director of the Specialized Unit for Economic Crimes, and the President of SONAMI, Jorge Riesco. In addition, various mining companies associated with the guild participated in the discussion.

The discussion featured active participation from all attendees and focused on addressing Law No. 21.595 – Economic Public Order, the characteristics of economic crimes, how the legislator approached corporate crime, the categorization of offenses and the expansion of the list of predicate offenses, the requirements for criminal liability, the topic of Corporate Criminal Liability (Law No. 20.393), the impacts of the law on the mining sector, multidisciplinary compliance, the design and implementation of an effective Crime Prevention System, and final recommendations.
